🧾 ELITE AUTO REPAIR – TERMS & CONDITIONS (SULTANATE OF OMAN)

By submitting a vehicle to Elite Auto Repair (“Company”), the customer (“Client”) agrees to the following legally binding Terms & Conditions:
1. Authorization to Repair
- The Client authorizes Elite Auto Repair to inspect, diagnose, repair, operate, and road-test the vehicle as required.
- Repair approval may be provided in person, in writing, by email, or via WhatsApp.
- WhatsApp approvals are considered legally binding contractual authorization.
2. Estimates & Advance Payment
Elite Auto Repair operates strictly on advance payment basis.
Payment Structure:
- Standard repairs: up to 100% advance (management may allow partial advance at discretion)
- Major repairs (engine, transmission, electrical systems, EV systems): 100% advance mandatory
- Elite Auto Repair reserves the right to refuse service without advance payment.
- All estimates are preliminary and based on visible conditions only.
3. Additional Repairs Discovered
If additional faults or requirements are discovered during repair:
- Client will be notified
- Revised estimate must be
approved - Additional amount must be paid upfront before work continues
- Failure to approve or pay may result in immediate suspension of work.
4. Diagnostic Charges
- Elite Auto Repair charges a non-refundable diagnostic fee of OMR 35.
- Diagnostic fees apply even if Client declines repairs.
5. Final Payment & Vehicle Release
Vehicles will NOT be released until ALL of the following are fully paid:
- Repair invoice
- Diagnostic charges
- Storage charges
- Additional approved costs
No exceptions.
6. Storage Charges
Upon notification of repair completion:
- 48 hours grace period applies
- After 48 hours: OMR 10 per day
Charges apply daily including weekends and holidays.
7. Late Payment Penalty
Any unpaid balance after completion shall attract a late payment penalty of 7% per month, calculated monthly until cleared.
8. Abandoned Vehicles
Vehicles unpaid or uncollected beyond 30 days may be classified as abandoned.
Elite Auto Repair reserves the right to:
- Notify Royal Oman Police
- Initiate legal recovery
- Dispose of vehicle per Omani law
All legal, towing, and storage costs will be borne by the Client.
9. Warranty Policy
Elite Auto Repair provides:
- 12 months or 12,000 km warranty (whichever comes first) on workmanship and Company-supplied parts only.
Warranty is void if:
- Vehicle serviced elsewhere
- Accident or misuse occurs
- Non-recommended oils/parts used
- Vehicle modified after repair
Warranty does NOT cover:
- Wear items (brake pads,
tires, bulbs, filters) - Pre-existing conditions
- Manufacturer defects
- Customer-supplied parts
10. Customer-Supplied Parts
- No warranty is provided on customer-supplied parts.
- Labor warranty may be limited or excluded.
Elite Auto Repair assumes no responsibility for incorrect or defective customer parts.
11. Test Driving Authorization
- Client authorizes Elite Auto Repair to perform short or extended road tests inside or outside premises as required for diagnostics or verification.
12. Personal Belongings
- Elite Auto Repair is not responsible for loss or damage to personal items left in vehicles.
13. Delays & Parts Availability
Elite Auto Repair is not liable for delays caused by:
- Parts availability
- Customs clearance
- Supplier issues
- Technical complications
Completion timelines are estimates only..
14. Commercial / Fleet / Rental Vehicles
Separate terms may apply for:
- Rental companies
- Fleet vehicles
- Corporate accounts
Retail customer warranty and payment terms may not apply
15. Legal Recovery of Unpaid Balances
- Elite Auto Repair reserves the right to pursue legal recovery for unpaid invoices.
- Client agrees to bear all legal fees, court charges, collection costs, and attorney expenses incurred during recovery.
16. Limitation of Liability
Elite Auto Repair is not liable for:
- Pre-existing vehicle faults
- Electrical failures unrelated to performed repairs
- Manufacturer defects
- Indirect or consequential damages
Maximum liability is limited to the amount paid for the specific service.
17. Governing Law & Jurisdiction
- These Terms & Conditions are governed by the laws of the Sultanate of Oman.
- All disputes fall under Muscat jurisdiction.
18. Contractual Acceptance
Approval of estimate via WhatsApp, email, signature, or verbal confirmation constitutes final contractual agreement between Client and Elite Auto Repair.
